DMCA Reports
Bigfirefashion is a creative apparel platform that lets users design and order custom merchandise — including tees, hats, jerseys, Hawaiian shirts, ugly sweaters, and all-over print items. We are committed to maintaining a respectful, lawful environment for both creators and rights holders. Bigfirefashion enforces a strict zero-tolerance policy toward the infringement of third-party intellectual property rights, including copyrights, trademarks, and related protections. If you believe content available on Bigfirefashion infringes your intellectual property, please submit a report following the procedure below.
A. Reporting Intellectual Property Infringement
Once we receive a valid and complete notice, Bigfirefashion will promptly review the report and may remove, disable, or restrict access to the content suspected of infringing intellectual property rights. Users who repeatedly infringe may have their accounts suspended or permanently terminated.
To submit an infringement report, please send the following information to our Designated Agent:
- Identification of the copyrighted work or intellectual property you claim is infringed, including any registration details (if available).
- A clear description of the allegedly infringing content, including the URL or exact location on the Bigfirefashion website.
- Your full legal name and complete contact information, including:
- Mailing address
- Telephone number
- Email address
- A statement of good-faith belief that the use of the content is not authorized by the rights owner, its agent, or the law.
- A statement, made under penalty of perjury, that:
- The information in the notice is accurate, and
- You are the rights owner or are authorized to act on behalf of the rights owner.
- Your electronic or physical signature (typing your full legal name is acceptable as an electronic signature).
B. How We Handle Infringement Notices
After we receive a valid and properly completed infringement notice:
- We will remove or disable access to the reported content where appropriate.
- We will notify the user responsible for the content.
- Repeat infringers may have their accounts suspended or permanently terminated at Bigfirefashion’s discretion.
C. Submitting a Counter-Notice
If you believe your content was removed or disabled in error, you may file a counter-notice that contains:
- Identification of the removed or disabled content and the URL where it previously appeared on Bigfirefashion.
- A statement, under penalty of perjury, that you have a good-faith belief the removal was a mistake or misidentification.
- Your full legal name and contact information (mailing address, phone number, email address).
- A statement consenting to the jurisdiction of your local court for any legal proceedings related to the dispute.
- Your electronic or physical signature.
Once we receive a valid counter-notice, Bigfirefashion may forward it to the original complainant. Content may be restored within 10 to 14 business days, unless the rights owner initiates legal action to prevent restoration.
False Claims Warning (DMCA §512(f))
Knowingly submitting false or misleading infringement notices or counter-notices may expose you to legal liability — including damages and attorney’s fees — under Section 512(f) of the DMCA.
